Welcome to AICraft. By accessing or using our API services, website, and related tools (collectively, the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, do not use the Service.

By creating an account or using the Service, you accept these Terms. AICraft reserves the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be notified via email or service announcement.

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your API keys and for all activities under your account. Notify AICraft immediately of any unauthorized use. API keys are shown only once at creation; AICraft stores only cryptographic hashes of keys and cannot recover lost keys.

Subscription Plans. Subscription fees are charged monthly in advance. Included token allowances reset each billing cycle; unused tokens do not roll over. International model usage is billed separately at published pay-per-use rates. Usage exceeding plan allowances is charged at pay-per-use rates.

Pay-Per-Use. Non-subscription usage is billed at published rates per 1,000 tokens. Prices are as published on the Pricing page. AICraft reserves the right to adjust prices with 30 days' notice.

Payment Methods. International site (aicraftapi.net) accepts PayPal and major credit/debit cards. All fees are exclusive of applicable taxes. You are responsible for any VAT, GST, sales tax, or similar levies.

Settlement Currency. International site (aicraftapi.net) settles in USD.

Availability Commitment. AICraft commits to 99.0% monthly service availability for paid subscription plans. Availability is calculated as: 1 minus (Failed Requests / Total Requests) times 100%. "Failed Requests" means requests returning 5xx errors due to AICraft infrastructure failure, excluding failures caused by invalid input, quota exhaustion, or upstream provider outages.

Credits. If monthly availability falls below 99.0% but remains at or above 95.0%, affected customers are entitled to a service credit equal to 10% of the monthly subscription fee. If availability falls below 95.0%, the service credit increases to 20% of the monthly subscription fee. Credits are applied to the next billing cycle. To claim, email support.int@aicraftapi.net within 30 days of the affected month. Service credits are the sole and exclusive remedy for availability failures.

Exclusions. SLA does not apply to: (a) Free plan accounts; (b) failures caused by upstream model providers; (c) scheduled maintenance (announced at least 24 hours in advance); (d) force majeure events; (e) failures caused by customer actions, including invalid API calls, quota exhaustion, or account suspension for Terms violations.

You agree not to use the Service for: (a) any illegal activity or violation of applicable laws; (b) generating fraudulent, defamatory, harassing, or privacy-invasive content; (c) content that promotes violence, terrorism, child exploitation, or hate speech; (d) weapons development, mass surveillance, or military applications; (e) any activity that interferes with or disrupts the Service; (f) unauthorized access, scraping, or reverse engineering. AICraft reserves the right to suspend or terminate accounts that violate these Terms without prior notice. Accounts terminated for Acceptable Use Policy violations are not eligible for refunds.

The Service provides access to AI models through AICraft's aggregation platform, which integrates services from multiple licensed providers and cloud infrastructure partners. These third-party providers and the underlying model developers retain full and independent control over their services and make no warranties regarding continued availability, output accuracy, completeness, or fitness for any particular purpose. Model availability, performance, and pricing are subject to these providers' conditions. AICraft does not guarantee uninterrupted availability of any specific model. AICraft is not liable for service interruptions caused by third-party provider outages, policy changes, or regulatory actions. If AICraft receives a service credit or compensation from a provider for an outage, a proportionate share will be passed through to affected customers.

AICraft processes data in accordance with its Privacy Policy and applicable data protection laws. By using the Service, you represent that you have obtained all necessary consents for data processing. AICraft acts as a data processor for content submitted by customers. International user data is stored on servers in Hong Kong, compliant with the Personal Data (Privacy) Ordinance (PDPO) and the EU General Data Protection Regulation (GDPR). AI requests and responses are not retained; if you require records for compliance purposes, you are responsible for maintaining your own request logs and generated outputs.

Disclaimer. The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, AICraft disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AICraft does not warrant that the Service will be uninterrupted, error-free, or completely secure. AI-generated content may contain inaccuracies; you should verify outputs before relying on them.

Liability Cap. To the fullest extent permitted by law, AICraft's aggregate liability for any claims relating to the Service shall not exceed the greater of: (a) the fees you paid to AICraft in the three (3) months preceding the event giving rise to the claim, or (b) one hundred US dollars (USD $100).

Consequential Damages. In no event shall AICraft be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, even if advised of the possibility of such damages.

Upstream Limitation. For failures attributable to third-party model providers, AICraft's liability is limited to the compensation it actually receives from that provider for the same event.

Monthly Subscriptions. You may cancel at any time. Cancellation takes effect at the end of the current billing cycle. No prorated refunds are provided for used periods. Prepaid months are non-refundable.

Annual Subscriptions. Annual plans may be cancelled within 30 days of activation for a full refund, less the value of tokens consumed at pay-per-use rates. After 30 days, refunds for the remaining period are issued as service credits only, calculated as: (remaining months / 12) times annual fee, less any discounts received.

Pay-Per-Use Credits. Prepaid credits are non-refundable. Unused credits remain in your account and do not expire for 12 months from the date of purchase.

Service Credits. SLA credits and promotional credits are not redeemable for cash and are non-transferable.

Either party may terminate this agreement at any time. AICraft may suspend or terminate your account for violation of these Terms, with or without notice. Upon termination, your right to access the Service ceases immediately. Post-termination data handling is governed by our Privacy Policy. Provisions regarding limitation of liability, indemnification, and payment obligations survive termination.

These Terms and any disputes arising out of or relating to the Service shall be governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles. The parties shall first attempt to resolve disputes through good-faith negotiation. If a dispute is not resolved within thirty (30) days, either party may submit the dispute to the exclusive jurisdiction of the courts of Hong Kong. Nothing in these Terms limits any mandatory consumer protection rights you may have under the laws of your country of residence.

For users located in the European Economic Area, United Kingdom, or Switzerland, you may also have the right to refer disputes to an alternative dispute resolution body or to bring proceedings in the courts of your country of residence, to the extent permitted by applicable law.

The Service is operated by Hainan AICreatrix Technology Co., Ltd., registered in the Hainan Free Trade Port, People's Republic of China (Unified Social Credit Code: 91460000MAKFXQ104N), with international service infrastructure in Hong Kong.
